    Exclamation CHAOS BANKRUPTCY UPDATE

    In the latest update pertaining to news of the Chaos Comics bankruptcy, the Trustee of the estate has stated that rather than selling the characters and properties off piecemeal, the Trustee will sell the entire package of former Chaos Comics characters as one item to the highest bidder. Additionally, the Trustee may seek, in the coming weeks, to bring Lady Death back into the Chaos estate, effectively voiding the sale of the character to CrossGen two weeks before Chaos declared Chapter 7 bankruptcy.
    According to a statement released by Steve Brown, legal counsel for the Chaos Trustee, Diane Mann, because of the complexities of the copyright and trademark issues surrounding the characters of the now-defunct comic book publisher, the Trustee is of the opinion that the most proper way to auction the characters off is to sell them as a lot, the sale of which would include the characters, as well as whatever rights Chaos had in its characters and other intellectual property. As Brown stated, “I know there were individual fans, employees and other players who were hoping to buy one or two characters either for business or personal reasons, but the nature of these assets simply does not lend itself to a character by character sale.”

    Originally, a sale of Evil Ernie was scheduled for October 25th, but cancelled due to questions over rights and trademarks.

    The sale date will tentatively be at the end of January, and the Trustee has not decided upon a minimum bid for the entire package.

    As for Lady Death, Brown stated: “It is the Trustee's belief that that transfer may be avoidable under the bankruptcy laws. It is possible that the Trustee, prior to the auction, may commence an ‘avoidance’ action to seek to bring Lady Death back into the bankruptcy estate. In the alternative, the Trustee could also include as part of the auctioned assets whatever rights she has to seek avoidance of the Lady Death transfer and recover rights to that character and/or damages for the loss of the character and its licensing revenues. The buyer [CrossGen] would then have standing to seek recovery of Lady Death for the buyer's own benefit. No representation or warranty is made as to the viability of that avoidance claim.”

    The characters of Jade and Bad Kitty may be pulled from the sale if the Trustee learns of a movie or television development project being green-lit prior to the sale, which would, in theory, maximize financial recovery for Chaos’ creditors.

    Brown said that the Trustee will be contacting parties which have previously expressed interest in the characters, as well as major comic book publishers in regards to the auction of all of Chaos’ characters. Opening bids for the entire package are being taken at this time, and can be altered to reflect the subtraction of Jade and Bad Kitty (if such deals occur), or presumably, the addition of Lady Death, if the Trustee commences and is successful in her avoidance action regarding the sale of Lady Death to CrossGen.

    When Newsarama asked CrossGen publisher Mark Alessi about a possible voiding of the sale of Lady Death shortly after it was revealed that a sale was made prior to Chaos filing for bankruptcy, Alessi expressed confidence in the transaction.

    "I know exactly what we did; I know exactly why we did it. I believe that the bankruptcy court will clearly uphold this transaction...Bankruptcy Trustees can attempt to do lots of things," Alessi told Newsarama. "Sometimes they can actually get away with it. I supposed LPC would be a good example of that. I think that if you look at the valuation that an outside organization did for Brian of his company, back out the valuation that they did for his physical inventory and valued it, the other assets of Chaos, including the 60 or so odd characters that Brian and Chaos owned, you’ll find that this price was probably more than equitable in light of the valuation. I don’t envision any problems."

    Exclamation LADY DEATH #1 IS TOP CG BOOK FOR FEB

    According to a post on the CrossGen messageboards by Brian Pulido, the new Code 6 Lady Death series, Brian Pulido’s Lady Death: A Medieval Tale was the top-ordered CrossGen book for the month of February.
    While Pulido did not quote a number of copies pre-ordered, or a chart position on Diamond’s Top 300, for the past two months, Sojourn has consistently been the publisher’s top-ordered book, according to Diamond’s Top 300 charts, ranking at number #88 in December, and climbing to #79 in January. If Lady Death is indeed in that neighborhood of the Top 300, it would have, according to January and December’s charts, roughly the same number of copies pre-ordered as DC’s Robin, Legion, and late Supergirl and Young Justice, as well as similar numbers to Marvel’s Spider-Girl.

    Ich kann nur sagen, WOW!!!!!!!!!!!! Das sieht absolut phantastisch aus! Ich bin schwerstens beeindruckt. Die Farbgebung ist völlig brilliant!

    LADY DEATH #1: GOING…GOING…GONE!

    Lady Death #1 Is Sold Out…

    Diamond Comics Distributors is sold out of BRIAN PULIDO’S LADY DEATH #1. After receiving a flurry of reorders, the distributor has shipped out every available copy of the first issue of the dark fantasy adventure, which stormed into comic shops on February 12th.

    LADY DEATH is leading a trend for debut issues from CrossGen Entertainment, as--despite aggressive overprinting--inventory of BRATH #1, the first issue of the barbaric adventure, and CHIMERA #1, the opening chapter of the computer-enhanced sci-fi thriller, is also quickly dwindling.

    “I’m honestly surprised at the reaction to the new LADY DEATH,” stated writer Brian Pulido. “Both retailers and readers have embraced it, which feels great. At the same time, the critical reaction has also been strong, and that’s new for me. Mark Alessi and the entire CrossGen team are challenging me to do my best, and I’m digging deep to make this a fresh take on the medieval fantasy epic.”

    “The CrossGen team is thrilled by the reader and retailer reaction to our trio of triumphs,” stated CrossGen Director of Marketing and Communications Bill Rosemann. “LADY DEATH, CHIMERA, and BRATH explore three different genres in three wildly different ways but with one successful result. So watch out for those second issues, because even though we overprinted, we have a feeling that they were under ordered and will soon be following the first issues right off the shelves!”

    Ich entnehme Deinen stetigen Erfogsmeldungen der Crossgen-Lady mal, das Ihr schon kräftig dabei seid Euch die Rechte für Lady Death zu sichern, um möglichst bald eine deutsche Veröffentlichung anlaufen zu lassen.

    Nein. LD ist ein Comic von C6C, das hier ist das C6C-Forum, und hier poste ich C6C-News. Was auch immer LD in D angeht, steht, wenn es diesbezüglich etwas zu vermelden gibt, im D-Forum oder sonstwo.

    Ich habe jetzt 1-3 von Lady Death (endlich) gelesen. Ein Gesamturteil möchte ich jedoch noch nicht fällen. Was mir an dieser neuen Lady Death allerdings gut gefällt ist, das der Chara nach und nach von Anfang an beginnt zu reifen. Das ist sehr viel übersichtlicher als bei Chaos! Wo man schon vor vollendete Tatsachen gestellt wurde und nur eine 3 (5, wenn man Untold tales und Fan Special mitzählt) Hefte Rückblende gegeben wurde, Bei der Crossgen - Serie kann man den inneren Wechsel von Hope zu Lady Death direkt miterleben.

    Ist eigentlich noch irgendwem aufgefallen, dass Obsidia sehr große Ähnlichkeit mit Jade hat?

    * Fabrizio Fiorentino will be penciling Lady Death # 7-9, filling in for Ivan Reis, who is getting married.

    * The first six issues will be collected in December.

    * CrossGen's line of statues/action figures begins with a reproduction of the cover of Lady Death #5.

    * Pulido said that previous Chaos! characters such as Evil Ernie, Purgatori and Jade "don't map to CrossGen's agenda" and won't be used.

    Story Spoilers:

    * Lady Death writer/creator Brian Pulido said that "something terrible" is going to happen in Lady Death #12. "It's a devastating event," Pulido said.

    * According to Pulido, Lady Death will get an "animal familiar" in either the 13th or 14th issue.

    Arrow Lady Death Movie Update auf comicscontinuum.com

    Andy Orjuela of ADV Films said at Comic-Con International that he hopes to have the Lady Death animated movie completed in time for next year's convention.

    The movie is targeted for a DVD release on Oct. 30, 2004.

    Orjuela, who debuted a trailer at Comic-Con that can now be seen at ADV Films' web site, said the most recent delay was his doing.

    "Basically, I wasn't satisfied with the story," Orjuela said. "I had to redo storyboards. And I experimented with the ending. I wanted to create an ending more true to her nature."

    Orjuela had just returned from three weeks of work in Korea, where the film is being animated. He said the movie is in the key animation phase, with the film scheduled to be completed in March and voiceover work shortly thereafter.

    Orjuela said the film will run 77 minutes, "although probably by the time I'm done with it, it will be 82 minutes."

    Die 12 CG Ausgaben reichen da wohl aus, da began man ja wieder bei 0. Aber laut Interview mit Pulido ist auch LD Vol. II ohne Kenntnis der ersten Serie verständlich...

    Yup, die ersten 12 Ausgaben oder die entsprechenden Travellers reichen für Komplettisten vollkommen aus; die Geschichte begann in der Tat wieder bei 0. Aber Vol 2 ist ein neuer Handlungsbogen, der für Neueinsteiger konzipiert ist, also, ran ans Heft!

    DEATH DUTIES

    Brian Pulido and William Christensen have bought Lady Death from CrossGen. They did so before CrossGen filed for bankruptcy.

    This strikes me as being a tad on the dodgy side. CrossGen did the same with Lady Death before Chaos filed for bankruptcy, and were forced to pay a lot more to Chaos' creditors by the courts.

    But it seems Christensen and Pulido did the deal with CrossGen Intellectual Property, a company which has not filed for bankruptcy.

    These legal loopholes, if they hold up, will see Avatar publishing Lady Death as part of their new Brian Pulido line of comics.

    And if one comic can escape the sucking black hole of CrossGen, maybe there's hope for others as well!
